Kayembe insists that the Platfields Limited chief executive is her legal husband, but Mbindwane says in court papers that they did not complete a customary ceremony in the Democratic Republic of Congo last year.
Court papers lodged in the South Gauteng High Court in Johannesburg reveal that the couple were scheduled to seal the deal with a civil marriage in September, but that trouble arose following Kayembe's termination of a pregnancy.
The termination triggered several heated altercations and confrontations.
In the court papers Kayembe says that at "the height of his maliciousness" Mbindwane threw "designer fashion label clothing, shoes and boots in the bathtub . [filled it] with water and laced it with bleach, Jik".
The clothes cost about R90000, she says.
Kayembe admits to trying to "pry [open] the locked boot" of Mbindwane's R1-million car, letting the air out of one tyre and smashing a side window of the car to get to her Gucci handbag, Jimmy Choo shoes, passport, modelling portfolio - and a wedding dress for the ceremony that was cancelled.
The Deal or No Deal presenter alleges that Mbindwane demanded that she vacate their Sandhurst home after discovering she had terminated her pregnancy.
Yesterday, the court granted Kayembe a draft order allowing her to continue living on the property.
The Congolese-born beauty, who has graced the covers of Cosmopolitan and FHM magazines, asked the court to order that Mbindwane return her belongings - including an Audi Q5 - and that he continue paying her R5000 a month, a cellphone contract, her credit card bills and the bond on the Sandhurst property.
In responding papers, Mbindwane says the couple were due to marry in a civil marriage in Cape Town in September and carried out "Congolese customary rites" only at her parents' home - but did not complete the remaining requirements necessary for a customary marriage.
Kayembe insists they were married under customary law on September 27 last year, despite their marriage not being registered with Home Affairs.
Mbindwane claims the bond and vehicle were paid for by a company he co-owned and by Platfields Limited, and that Kayembe is not entitled to either.
He accuses Kayembe of trying to "extort as much money as she possibly can from me".
Kayembe claims that she attempted suicide during a previous break-up, and that Mbindwane assaulted her.
The model alleges that during a physical tussle over a cellphone - during which she dived into a swimming pool into which he had thrown her phone - Mbindwane realised that she was "not pregnant".
"He then screamed that I was a murderer," says Kayembe. "He told me that I would rot in jail for the murder of his unborn child."
In her court papers the former Sports Illustrated Swimwear model alleges that one particular assault ended with the businessman being detained at the Bramley police station.
In his court papers Mbindwane denies assaulting Kayembe and insists that he only shouted that she was a murderer.
The case was postponed to later this month.
