An Australian comedian whose pet goat nibbled at a flowerbed in a central Sydney park had his 440-Australian-dollar (US $462) fine for "damaging vegetation without authority" cancelled Wednesday.
The magistrate agreed with police that the goat had eaten plants but ruled that owner Jim Dezarnaulds could not have stopped him.
She said no evidence was presented to show that he had brought the goat to the park to feed, and remarked that "he may have preferred to have an ice cream."
Dezarnaulds, 42, who lost his bid to have his legal costs paid for, said the case should never have been brought to court.
"I gave the police every chance I could to not let this case be a waste of time on the court system, which I believe it is," he said.
