High court to rule on state's appeal in al-Bashir case

The high court in Pretoria will decide next week whether to grant the state leave to appeal the court’s finding that the government’s conduct was unconstitutional when it ignored a court order to arrest Sudanese President Omar al-Bashir. The International Criminal Court (ICC) has found that al-Bashir committed the crimes of genocide‚ crimes against humanity and war crimes in Darfur.The Southern Africa Litigation Centre (SALC) said in a statement on Friday that the judgment would be handed down on Wednesday‚ September 16.Al-Bashir attended the African Union summit in South Africa in June this year. South Africa is a signatory to the Rome Statute‚ obligating it to arrest the Sudanese president. The SALC approached the high court to have the ICC arrest warrant implemented. An order was issued preventing al-Bashir leaving the country.But al-Bashir left the country‚ departing from Waterkloof Air Force Base. His aeroplane departed at the same time the high court was dealing with application for his arrest...
