Court hears of rape-accused Eldorado Park father's drug-fuelled orgies

The community of Eldorado Park vowed to take the law into their own hands if a man accused of raping his daughter was released. A packed Protea Magistrate's Court in Soweto heard this on Monday as the man applied for bail.The 48-year-old man‚ who cannot be named to protect the identity of his daughter‚ is facing several charges of rape for allegedly repeatedly raping his 11-year-old daughter.The man has four previous convictions of assault‚ robbery and drug possession‚ the court was told.The court heard how the accused would allegedly have drug-fuelled orgies in the presence of his daughter. In an affidavit‚ the girl said her father would often rape her and force her to perform oral sex on him.A medical examination indicated that she had been penetrated. There was bruising along her vaginal walls and her hymen had been damaged.The rape of someone younger than 16 is a crime listed in Schedule 6 of the Criminal Procedure Act and someone accused of such a crime must‚ in order to get bail‚ prove to the court that there are exceptional circumstances that allow for them to be granted bail.The state told the court there were no exceptional circumstances that permitted the man be released on bail.As the biological father of the complainant‚ he might instil fear in her‚ prosecutor Sizwe Mthethwa said.Mthethwa said the man had committed crimes before and was a flight risk.Mthethwa told the court that residents of Eldorado Park‚ southwest of Johannesburg‚ had told him they would take the law into their own hands should the man be granted bail.The accused man said in an affidavit that the mother of his daughter laid the rape charges against him so that she could have his flat.He also accused the girl's mother of being a drug addict.Magistrate Robert Badenhorst told the man that the evidence pointed to the girl having been sexually assaulted and he did not find the accused's testimony convincing.Bail was denied.The man is due to appear in court again on Thursday. - TMG Courts and Law..
