Hawks turn to SCA in bid to enforce top cop’s suspension

The Hawks special crime-fighting unit is to file a petition with the Supreme Court of Appeal (SCA) after failing in its appeal last week against a High Court decision overturning the suspension of its Kwazulu-Natal head Major General Johan Booysen. Judge Anton van Zyl ruled in the Durban High Court on Wednesday that there was no prospect of a successful appeal against his November 18 ruling that overturned a decision to suspend Booysen amid allegations of fraud. Hawks spokesman Brigadier Hangwani Mulaudzi said the unit’s national head‚ Lieutenant General Mthandazo (Berning) Ntlemeza‚ had noted the High Court’s ruling and after consideration had taken legal advice.“Lieutenant General Ntlemeza has decided to take the matter further by instructing his attorneys to file a petition with the Supreme Court of Appeal (SCA) against the judgement of the High Court.“Pending the finalisation of the petition‚ the status quo will remain to the effect that Major General Johan Booysen remains on suspension‚” Brig Mulaudzi saidBooysen was suspended on September 14 last year by Ntlemeza shortly after he assumed the role as national head of the Hawks...
