Lawyer’s illness causes delay in Mhere homicide case

The case against the man accused of causing the death of Top Billing presenter Simba Mhere was postponed on Monday because his lawyer is sick. Preshalin Naidoo‚ 24‚ appeared in the Randburg Magistrate's Court facing two charges of culpable homicide.Tracker evidence in Mhere case could lead to trial within a trialThe lawyer of the man accused of causing Top Billing presenter Simba Mhere’s death has challenged the authenticity and admissibility of new evidence the state intends using. His case had to be postponed because his lawyer‚ advocate Francois Roets‚ took ill.“I received a text message from advocate Roets informing me that he has a stomach bug. He asked that he matter be rolled over to tomorrow‚” said instructing attorney Luando Voster.Prosecutor Dinesh Nandkissor objected to the postponement arguing that the case has been delayed and should have been at an advanced stage. He asked the court to hear heads of arguments from both the state and the defence before the case was postponed.The court‚ however‚ granted the defence’s application for a postponement.Mhere and his friend‚ Kady-Shay O’Bryan‚ who was a passenger in the car Mhere was driving‚ died at the scene of the accident on William Nicol Drive in Fourways‚ on January 31‚ 2015.– TMG Digital..
