Heath's job on the line - after just one week

Barely a week after taking over the hot seat as head of the Special Investigating Unit, advocate Willem Heath's future hangs in the balance.

In a dramatic twist, it now appears as if Heath might have struck the wrong chord with President Jacob Zuma over controversial comments he made about former president Thabo Mbeki last week.

Yesterday, Zuma told an SABC radio station that he would study Heath's comments made during a wide-ranging interview with City Press published at the weekend.

During the candid interview, Heath accused Mbeki of "initiating" rape and corruption charges against Zuma in the run-up to ANC's leadership race in 2007.

He also said Zuma's former financial adviser, convicted fraudster Schabir Shaik, and senior ANC member Tony Yengeni, were "sacrificed" in the arms deal investigation and that Judge Hilary Squires' judgment in the Shaik corruption trial was flawed as there was insufficient evidence to convict him.

Zuma yesterday told Ukhozi FM that he would seek legal advice from Justice Minister Jeff Radebe regarding Heath's statements.

Zuma - who in a surprise move appointed Heath to the top job last Tuesday - said he would also look into whether the former judge held "any grudges" against anyone before deciding on any action.

Zuma's move against the man who advised him in his rape case - in which he was acquitted - and who was part of the team that got corruption charges against him withdrawn, comes as internal complaints against Heath circulate among ANC members.

Party members who spoke to The Times said Heath's "factional" statements, if unchallenged, could cause damage to the already fragile organisation.

"This man [Heath] is not aware of the damage he has caused with his statements," said a senior party member in Gauteng.

"We don't need this, especially as we prepare for our centenary, and now Zuma will have to explain himself, both in and out of the ANC, because of Heath," he said.

The DA and Council for the Advancement of the South African Constitution have slammed Heath's appointment.

Heath previously headed the SIU until 2001, when the Constitutional Court ruled that, as a judge, he could no longer run the unit, an independent statutory body.

Heath, whose appointment was praised by the Presidency last week, has always been vocal about the pain he felt after he was forced to relinquish his SIU post 10 years ago.

Mbeki, who was president at the time, refused to grant Heath an early retirement package and he was forced to resign as a judge.

Last week, Heath told City Press that Mbeki's decision had left him a "pauper".

Asked if he was bitter about the previous ANC leadership, Heath, during the interview, said: "Obviously I was most unhappy about the way in which I was treated and that I was left destitute, so I wasn't happy with that."

However, Heath said the ANC under Zuma was "a completely new and different group".

"So they approached me with such sincerity and I accepted that they were not part of the old school, and that they were entitled to get to the truth of matters."

Heath conceded that he was sympathetic to Zuma and said he believed that his tribulations then were part of a conspiracy by the old ANC leadership.

Throughout the interview, Heath heaped praise on Zuma, again defending him, saying that the money Shaik paid to Zuma was "part of a culture, and friendship and camaraderie, so it was a very common thing for those who had money to support the others".

This Heath Guy was not suppose to be appointed in the first place. This takes us back to the strange decisions taken and bad advise Zuma is getting as well as poor Leadership in the ANC. You can see that this mor*n is on a mission to divide the already divided ANC even further but anyway who cares??

As to President Zuma receiving legal advice from Minister Radebe - now that's a non-starter. The court records leaves much to be desired so far. He might as well be consulting a bush lawyer from Inkandla.

All those undiplomatic statements reveal the possible reasons for his appointment, and the fact that he seems to be deeply involved and strongly biased in all ANC factional battles - and therefore justify all reasonable concerns around his appointment and suitability for the position.

The simile between the Heath and Williams circumstances is to too obvious to igonre. Heath is obviously disgruntled at Mbeki and he aims to shove it right up that dictator ....hole.

In my opinion Heath has just brought or hinted on the sentiment shared by most and amongst the ANC membership during the rape case court hearings as well as prior to Polokwane.

So should someone make a statement concerning the death of Chris Hani while in the same sentence includes Thabo Mbeki name,will that person be in the hot water,I do not think it should be the case such statement have brought into the public domain and opinions were raised.

The problem with the ANC they are more concern by their 'cheap' unity instead of tackling the issues and get it resolved once and for all.

There was this media hype about Willem Heath during the mbeki administration to the extent that some of us thought he was one of the finest minds as far as the SA judicial system is concerned. However, after reading some of the comments he made in his interview with the city press, I was left baffled. I could not believe the folly and narrow mindedness that come from the man. He sounds incredibly stupid and a liability to the judicial system.
JZ must do the necessary and show the old man the door.

I thought that the point of Heath's appointment was just that - the president surrounding himself with "yes" men/women. Obviously the man in question doesn't know when to shut up, and now it is a problem.
In any case, public servants are "forced" to go on pension at 65, why doesn't this count for government?

There is nothing wrong or hurtful on Heath's statement, he is just telling the truth. Indeed the rape lady was used and Yengeni was a scapegoat. In more than R100m arms deal unaccounted money, Yengeni was accused of discount on a car and less tahn 3 million of Shabir 's corruption conviction. It is very clear that the NPA were just puppets who chose their targets on intructions. It was a public knowledge that political batles were fought by NPA and Scorpions, judges took part as well, remember Ngoepe's handling of warant on Zuma lawyers, the Harms of Appeal Court who claimed corrupt relationship even though it was never founded. The same Harms tried to cover up for Vlakplaas, so stop pretending that there is justice around here.

Aaron Gumede, your comments are reckless and unfounded as those made by Heath and they are not informed by facts but emotional rhetoric. It is pronouncements like yours that divide societies and brew discord even where is none. who in your opinion used the rape lady because if I can recall it is Zuma who took advanatge of a vulnerable HIV positive daughter of a comrade and had sex with her in his house not even using a condom. You need to call Zuma intially denied having had sex with the lady and he only changed his statement to consensual sex after he was confronted with DNA evidence. And about the alleged political interference you seem to base your arguments on the flawed and embarrassing judgment given by judge Nicholson who presumed the presence of such interference which was not supported by any facts or even without inviting Mbeki or anyone from government to give evidence. We all know what happened to that judgement in the high court of appeal as it was rubbished and thrown out with contempt. If you have any thread of evidence contrary to what is factual and what we know, please enlighten us rather than be making baseless, wild and dangerous rhetoric statements devoid of truth and any imagination.
