Julius Malema's appeal to the National Disciplinary Committee of Appeal (NDCA) regarding his suspension has failed.
NDCA chairman Cyril Ramaphosa announced in a press conference that the NDCA found no basis to vary the findings of the National Disciplinary Committee (NDC) on Malema's charges but appeal to argue in mitigation of their suspensions was granted.
"The matter will be referred back to the national disciplinary committee... the hearing must be conducted within 14 days," Ramaphosa said.
Malema was in November 2011 suspended from the ANC for five years and fired as president of the league for bringing the ANC into disrepute and for sowing divisions in the organisation.
Last month, Malema's defence team presented oral arguments to the ANC’s NDCA detailing why his five-year suspension should be overturned. Malema and other senior ANCYL leaders were suspended after being found guilty of sowing division within the ANC and of bringing the party into disrepute.
