“Disciplining his subjects” has earned AbaThembu King Buyelekhaya Dalindyebo’s a 12-year prison term and expulsion from the Democratic Alliance. The party said in a statement on Thursday that “membership of King Dalindyebo will be cancelled following the Supreme Court of Appeal (SCA) ruling that upheld charges of assault‚ arson‚ kidnapping and defeating the ends of justice”.This‚ the DA said‚ “is in accordance with the DA’s Constitution which expressly stipulates that membership to the party will be revoked if someone is ‘found guilty of any offence listed in Schedule 1‚ 2‚ 5‚ 6 or 7 of the Criminal Procedure Act’”.The king was convicted in the Mthatha High Court of crimes including arson‚ assault with intent to cause grievous bodily harm‚ culpable homicide and defeating the ends of justice in 2010.He was sentenced to an effective 15 years in prison‚ but he appealed the case to the SCA‚ hoping to escape jail in its entirety. The sentence was instead replaced with one of 12 years."Dalindyebo must now report to a correctional centre within the jurisdiction of the court where he was convicted (Mthatha) within 24 hours‚" Justice Department spokesman Mthunzi Mhaga said.Dalindyebo's only available legal avenue now is to appeal to the Constitutional Court."But he can only do this on the grounds of his constitutional rights being violated‚” Mhaga said. The charges he was convicted on stem from incidents in which he was said to have punished his subjects for after one of them failed to present himself before a traditional court. - The Herald‚ RDM News Wire..
