Public protector candidate’s legal advice to Parliament on Nkandla a sticking point

Two major shocks rocked the public protector candidate interviews in Parliament when it was revealed that one candidate lacked security clearance and another was forced to admit - after much dodging - that she was an African National Congress (ANC) member. The security clearance matter apparently concerned a letter from the State Security Agency that the current deputy public protector‚ advocate Kevin Malunga‚ did not have the requisite security clearance to follow in advocate Thuli Madonsela's footsteps. The matter was to be cleared with him later.And advocate Nonokosi Cetywayo‚ a clear favourite with ANC members of the committee‚ was exposed as an ANC member by African Chrsitian Democratic Party (ACDP) MP Steve Swart and Economic Freddom Fighters (EFF) chief whip Floyd Shivambu after initially claiming she was “not an active ANC member”.Committee chair Makhosi Khoza and ANC MP Bongani Bongo claimed that her ANC membership was not a problem‚ a point loudly disputed by MPs of the Democratic Alliance‚ EFF and ACDP.Cetywayo was also hazy on which advice she had given to former speaker Max Sisulu regarding the ad hoc committee on the Nkandla issue‚ apparently forgetting that the appointment of the initial committee preceded her departure as legal advisor to Sisulu.Cetywayo furthermore raised the ire of opposition MPs by arguing that the public protector should focus more on pro-poor issues while arguing that the public protector could have handled the Nkandla issue differently.
