Airing porn legal, says Icasa

The Independent Communications Authority of SA has denied any wrongdoing for granting pay TV station StarSat a licence to air porn movies during prime time.

Icasa is embroiled in a bruising legal battle with the Justice Alliance of SA, which is fighting "to keep porn off TV in the living room".

The alliance has alleged that Playboy duped Icasa into granting the licence by saying it would only broadcast "sex between couples in loving relationships and sexually empowered women".

But advocate Paul Kennedy, representing Icasa, denied that StarSat had hoodwinked the regulator. He said there were relevant bodies, such as the Broadcasting Complaints Commission of SA, to deal with future breaches.

However, Judge Lee Bozalek slammed Icasa for gazetting inadequate information about its intentions to grant the licence to the pay TV on December 19 2012.

Icasa granted Top TV - which later changed its name to StarSat - the licence to air Playboy TV, Desire TV and Private Spice in April last year.

The matter is to be concluded today.
