A man, known only as Herbert O, told an East Frisian court that his penis is too small to be noticed.

According to the Daily Mail, O had apparently flashed a teenage girl while delivering a package in August of 2013.

Evidently the girl had good eyes, because she and her mother went to the police to lay a complaint against him.

O responded to the charges by claiming that his penis was way too small for the girl to have noticed it, even getting his wife to testify to his lack of inches.

'I'm sorry, darling, but your penis is too short to hang out of your trousers,' she told the local court in the town of Leer in East Frisia.

The judge, on the suggestion of O's defence lawyer, ordered the coroner to measure his manhood.

'If the wife has spoken out so frankly about this, I have to follow it up,' Judge Ulrike Andrees said.

Time will tell whether this defence stands up in court.
