An elderly man claims that his penis eroded because insurer wouldn't let his healthcare provider remove his catheter.

Rupert Collins is sung  Kaiser Foundation Health Plan, Inc. in a Napa County Superior Court for elder abuse, negligence and unfair business practices according to the Courthouse News Service.

According to his lawsuit he was a patient at a non-party Napa Valley care centre when he developed problems with his catheterised penis.

After nurses noticed that Collins' penis was swollen with what was described as a cut, they repeatedly asked the insurer for permission to remove the catheter.

The insurer said no.

Then Collin's daughter took a look.

"When Diana examined Rupert's penis, she was horrified at what she saw. Rupert's penis was split completely in half from the tip of his penis all the way down to the scrotum sac," according to the complaint.

She pressed the issue until they sent out their own urologist.

"Rupert's penis and urethra is permanently eroded away and Rupert has suffered permanent genital mutilation," the urologist concluded.

He also said if the problem had been treated earlier, the penis could have been saved but as it was it was too late even for reconstructive surgery.
