Preshalin Naidoo‚the man accused of causing Top Billing presenter Simba Mhere's death‚ will not be prejudiced if the state introduces new evidence in the case.This was the Randburg Magistrate's Court ruling in an application by the state to call new witnesses - one from a car tracking company and another from an insurance company. The state on Monday said the evidence from Cartrack will show the movements of Naidoo's car on the day of the incident. Naidoo is facing two charges of culpable homicide. "Central to the question [of allowing the state to call the two witnesses] is whether it will be fair to the accused."I am of the view that no prejudice will be suffered by the accused when the state is allowed to lead new evidence."The state is allowed to present evidence as contained in the tracking report‚" Magistrate David Mahango said on Tuesday.Naidoo's lawyer Advocate Francois Roets earlier argued that it was late for the state to be introducing new evidenceRoets argued that the state was conducting a "trial by ambush" for wanting to lead new evidence at an advanced stage of the case...
