Was EFF leader Julius Malema guilty of hate speech when he said he “did not have to kill” journalists he believed were dishonest? And should he and his political party be held responsible for their supporters’ purported acts of intimidation against the media?

These questions go to the heart of an application brought before the Equality Court on Monday.
