Herman Mashaba ramps up illegal immigrants battle

Johannesburg mayor Herman Mashaba has instructed the city's legal representatives to take the Department of Home Affairs to court for not acting on illegal immigrants.On Friday, Mashaba told The Sunday Times that he was prepared to take the fight all the way to the Constitutional Court because the sheer numbers of illegal immigrants were making it impossible for the city to render good services to South Africans.He also believed South Africa's porous borders bear testimony to the Home Affairs Department failing its constitutional duties.Top advocates Dali Mpofu SC and Tembeka Ngcukaitobi would act on the city's behalf, announced Mashaba, who said the plan had been for a lawyers' letter to be sent to the department by late Friday afternoon.However, delays have meant that the lawyers' letter has not yet been delivered."Let me make one other thing clear: I am not calling for undocumented immigrants to be immediately deported," Mashaba said, adding that he was not xenophobic. "The government must ensure that all who qualify for asylum or other permits are processed and provided with their papers timeously. Should individuals not qualify, or should they have committed crimes within our borders, then they should be sent home to where they came from."A home affairs spokesman said the minister would await the official legal processes and respond at the right time...
