Basetsana Kumalo wins court case against cycling shop

Media personality Basetsana 'Bassie' Kumalo has won a court case against a cycling retailer after they unlawfully used an image of her in an advert.

Kumalo took Cycle Lab to court in May 2010 over the Fourways retailer's use of her picture without her permission.

Commenting on the case law firm Kumalo, Adams & Adams, said: "Kumalo had no objection to being photographed but did not consent to the use of her photograph for the purposes of advertising."

The photograph in question was taken while Kumalo was shopping at Cycle Lab in 2007 and was later used by the retailer in an advertisement.

Sowetan reported that Kumalo was suing Cycle Lab for R750 000.

Testifying in May 2010, Kumalo was quoted as saying: "My face is my business. My brand value has been devalued.

They portrayed me in a way that could lead to potential clients thinking I have gone down the drain."
