‘She has been fighting for her child since March’ — Inside Sithelo Shozi’s legal battle with Andile and MaMkhize

Sithelo Shozi's legal team claim the DJ has been fighting for the child she shares with Royal AM chair Andile Mpisane since March last year.

Sithelo is Andile's former girlfriend and the pair share two children together. The child is in the middle the legal battle is their eldest daughter. 

The DJ served a summons to Andile and his wealthy businesswoman mother Shauwn Mkhize last week.

She accused them of not returning her three-year-old daughter to her after a visit. 

In court papers TshisaLIVE has seen, Sithelo claims she has not been allowed to visit her child since she was taken from her in March last year.

Tony Mathe from Marweshe Attorneys said in legal terms their client's daughter was abducted despite the pair's legal team denying the child was abducted.

"It is important for us to clarify the nonsensical claims that our client was paid by somebody for her silence for the abduction of her daughter or otherwise. We confirm that never happened. Our client is not acting punitively but legally in getting her daughter back and have her abductors answer to a court of law. Her child was abducted as defined by law, not by personal opinions. Further clarification of the abduction will be done in a court of law and not on social media and other platformse."

Speaking to Sunday Times, the legal representative for Andile and MaMkhize, Ntsako Godi, denied they had abducted the child and said they would oppose Sithelo’s application.

“We will defend this application and we are confident of our case. This is a media attention-seeking stunt,” he said

“The child was never abducted and has at all times since birth been raised in the house of MaMkhize and Andile,” he told Sunday Times.

Sithelo's legal representative explained to TshisaLIVE what caused delays in efforts to bring the matter before the courts.

"The delays of 10 months were not her own doing but it was a legal process of letter exchange, which we do not see having been necessary. This was before we came on record. Sithelo has been fighting to get her child back since she was unlawfully taken from her in March. We wish for this matter to be dealt with in court by law and not on social media by personal opinions."

In the legal documents Sithelo also accused  her ex-boyfriend and his mother of forcing both her children to undergo DNA tests to prove paternity.

Her legal representative asked for the DJ be given the space and privacy to deal with the matter legally.

"This is a very sensitive and personal issue to Sithelo. Space for this matter to be dealt with in court is important. We cannot prejudice and jeopardise the matter by commenting on the merits."
