The fraud case against businessmen Gary van der Merwe and Paul Kilian was postponed in the Cape High Court on Thursday to await a Supreme Court of Appeal (SCA) ruling.
Legal Aid South Africa (Lasa) has petitioned the SCA for leave to appeal a high court ruling that it pay for the defence of the two men, whom it believes may have assets worth millions.
Advocate Gary Botha, for the state, said on Thursday that the Lasa application was lodged on March 9, and other parties had until April 9 to file responding affidavits.
Van der Merwe told the court that he intended to file papers opposing the Lasa application.
Acting judge Phakama Ngewu postponed the matter to April 21.
