Nape Phasha was not at the scene of a car crash which claimed the life of a 31-year-old biker nor was he involved in the fatal incident, this is according to his attorney, Michael Bill Motsoeneng.

The legal team representing 'Vuzu rich kid' Nape Phasha has clarified the details surrounding the 21-year-old's alleged involvement in a fatal car crash and have indicated their intention to sue @PigSpotter for defamation of character.

Motsoeneng is representing Phasha in a legal case in which the Wits law student was pointed out by @Pigspotter and others as the driver of a black Mercedes Benz which collided with a biker in Garsfontein, Pretoria on the evening of 13 August.

Motsoeneng has brought a case of defamation of character against @PigSpotter and Jakobus Delport as the two published claims on their Twitter and Facebook accounts indicating Phasha fled the scene of the collision.

@PigSpotter, whose identity is revealed in the summons as 33-year-old Cliff Ricardo Santos Pinto of Lambton in Germiston is being sued for R500,000 for making damaging, wrongful and defamatory statements against Phasha. Pinto, who has tweeted about the presence of police roadblocks, speed cameras and the general presence of police on Gauteng streets since 2010 has been a constant headache for the metro police and SAPS.

According to the summons, which will be served to Pinto and Delport, their tweets and Facebook status', published between 13 and 15 August were republished to Twitter users and reported on by South Africa's major news outlets.

"As a result of the defamation the plaintiff received various threats of assault and threats to his life. The plaintiff's reputation has been damaged..." reads the summons.

Pinto and Delport have further been instructed to make a public apology and complete retraction of their statements relating to Phasha on their personal social media accounts as well as in a major newspaper.

Capt Coba Brits, spokesperson for the Sunnyside cluster said the police were investigating the fatal crash.

"Statements were taken, an investigation is ongoing and we are waiting for a post-mortem and photos of the incident. We are in contact with the lawyers of all the parties involved and are on top of everything," said Brits.

Phasha featured on Vuzu Rich Kids earlier this year where he spoke of his wealthy lifestyle. The show chronicled the lives of rich sprogs and Phasha was the first to have his episode flighted on Vuzu Amp. The political sciences University of Pretoria graduate soon became popular, with an increase in his social media following and a string of media interviews with radio stations such as 5FM.

However, after Pinto and Delport claimed Phasha had been involved in the accident, publishing images of a him and a car apparently registered to the Phasha family, his image took a serious battering and he had to contend with allegations of police bribery and corruption.

"The allegations made about Phasha were vulgar and we are taking the necessary steps to ensure his dignity is restored," said Motsoeneng.
