Arrest warrant against cop accused of killing wife withdrawn

A warrant of arrest issued against a policeman accused of killing his wife three years ago was withdrawn in the high court.

Judge Jacobus Strijdom withdrew the warrant of arrest against Sergeant Kennedy Edward Fox‚ 35‚ after his legal team told the court that there was confusion when they consulted over the weekend.

Advocate Mabuse Monareng told the North Gauteng High Court sitting in Vereeniging‚ that he consulted with Fox over the weekend and he told him that the trial will continue on Tuesday.

He said on Monday he was in Bloemfontein on another criminal matter and could not attend Monday's proceedings.

Fox later made a u-turn when he withdrew the services of both Monareng and his instructing attorney Thomas Mahlobogoane.

He said he was not satisfied with how the proceedings went.

This came after Monareng asked for a postponement because he needed to prepare before state prosecutor Gerrie Nel could call a forensic expert.

Monareng asked the court for more time to consult with their own forensic expert before the witness could be called.

Nel said there were more delays in criminal matters.

“We always hear this argument that the accused must get a fair trial. Whenever the defence argued that‚ the court bends backwards. We have victims here and the defence is not ready to cross-examine. On December 5 (last year) the court could not proceed because there was no expert‚” he said.

Fox who is attached to the Vaal Rand Flying Squad‚ allegedly killed his wife Chê Fox‚ 27‚ at their home in Rus-ter-Vaal in the Vaal Triangle on November 6‚ 2014. The policeman allegedly fired a bullet through her head and later went outside the house and fired through the window.

He allegedly claimed that his wife was shot and killed by an intruder who fired bullets through the window.

The trial continues.
