Hlophe's son back to face fraud charges

Cape Town High Court Judge President John Hlophe's son, Thuthuka Hlophe, will be hauled before court to answer to a litany of charges today.

The Bellville Regional Court convicted Thuthuka in September 2010 after he pleaded guilty to charges of fraud, defeating the ends of justice and violating the Identification Act.

His plea was overturned in December after his advocate, Thembalihle Sidaki, said he had identified "problems" while studying the charge sheet and during his consultations with Thuthuka.

"Consequently, the court is asked to consider correcting the plea of guilty to all charges. It would also appear that there are several instances [in which] the conviction of the accused is not in accordance with justice," Sidaki said in court papers.

The matter is back on the court roll for today.

"The charges relate to a fraudulent loan application and opening a bank account by presenting forged identity documentation, and depositing fraudulent cheques," the National Prosecuting Authority said.

"He also presented fraudulent cheques for various goods sold and services rendered to him including a vehicle, of R400000."

Thuthuka was arrested in March 2009 for allegedly using fake cheques to buy a BMW 330i, eucalyptus wooden boards and a scooter.

He is also accused of producing a false pay slip to obtain a loan from Capitec bank.
