Judge rules 'Sunday rapist' counselling sessions inadmissible

Counselling sessions between Johannes Jacobus Steyn, dubbed the "Sunday rapist", and his employer were ruled inadmissible evidence today.

Allowing the information contained in these discussions to form part of the evidence this late in the trial might infringe Steyn's rights, Judge Sita Kolbe said in the High Court, sitting in the Palm Ridge Magistrate's Court, in Alberton.

Details of these counselling sessions which took place in jail after Steyn's arrest did not form part of the docket and were not in writing either.

Kolbe said she would give full reasons for her ruling at the end of the trial.

Earlier the ninth alleged "Sunday rapist" victim gave a graphic account in court of her attack.

"He greeted me. Then he pointed a gun at me and said I should do what he said or I'll get hurt," the now 18-year-old said.

Steyn faces two counts of murder, 11 of rape, 10 of sexual assault, 10 of kidnapping, one of attempted sexual assault, one of attempted kidnapping, and two of assault.

He has pleaded not guilty to all the crimes, committed during 2008 and 2011. The murder charges relate to the deaths of schoolgirls Louise de Waal and Lazanne Farmer.

The teenage girl testified that she, 16 at the time, and her sister, were walking to a cafe in Rustenburg on March 7, 2010.

A white bakkie drove past them twice and stopped next to them the third time. She said a man wearing sunglasses and a hat pulled her into the bakkie and drove off.

He told her to use a sock, which was on the floor, to blindfold herself.

"There was alcohol on the floor. He opened one and put it in my hand. I took a few sips and said I didn't want any more." He also lit a cigarette for her and told her to smoke it.

"I asked him why he chose me. He said it was because I was the prettier one out of the two of us, that's why he picked me."

Once they stopped he partially undressed and touched her.

"He touched me and I pushed him away and I said he must leave me alone." He took her bra and hid it under the car seat. She described how she was sexually assaulted.

Afterwards he told her to get dressed. He removed her blindfold and replaced it with her t-shirt.

"When I took the shirt off the car was gone." She walked towards a road and a man found her crying.

"He asked me why I was crying... He then told me I didn't need to tell him. He took me home."

Earlier, pathologist Dorothea Joubert testified that no medical help would have saved murdered teenager Lazanne Farmer.

"I doubt that with the amount of brain injuries she had."

She said she died from head injuries. Farmer's skull was fractured. There was blood in her nose, mouth and ears, and airway, indicating she was breathing at the time.

These functions were likely to have been of peri-mortem nature, when the body was shutting down, Joubert explained.

She said the injuries were typical of someone who had jumped, or fallen, out of a car.
