The Western Cape High Court has fined a police officer R3000 and given him a suspended sentence for making a video of a colleague kissing and touching a woman.
In sentencing Constable Jaede Fillies on Wednesday, the court found he had acted "recklessly" on June 15, 2010.
He was given a six-month jail sentence, suspended for three years, on condition he was not convicted of a similar offence in that period.
Fillies and Warrant Officer Theodore Syster were acquitted of allegations that they raped a 29-year-old woman in 2010 and took her to Elsies River police station.
Syster was alleged to have raped the woman inside the station toilet while Fillies made a cellphone recording of the act.
Instead of reporting the misconduct, Fillies kept it on his phone.
Fillies was found guilty of crimen injuria. An internal disciplinary hearing resulted in a fine of R500 and a three-month suspension from duty.
On Wednesday, Judge Patricia Goliath reportedly said she had taken into account that Fillies was in full police uniform that day, the incident occurred at a police station, that he was a first time offender, and had no pending cases against him.
