The National Directorate of Public Prosecutions will respond to questions surrounding the prosecution's conduct in the criminal trial of Durban businesswoman Shauwn Mpisane in September.

The trial was postponed yesterday to September 16 to allow it to respond to representations by Mpisane's legal team.

The team told the Durban Regional Court yesterday that prosecutor Meena Naidu had withheld two-thirds of the documents in her possession and the state was suppressing evidence.

Acting director of public prosecutions in KwaZulu-Natal Moipone Noko said she had been following proceedings closely and no unethical behaviour had been reported to her.

"It is postponed pending the acting head's response to the representations that the defence recently forwarded to her office."

Mpisane is accused of submitting false financial statements to SARS to reduce the 2008 tax bill of her company, Zikhulise Cleaning, Maintenance and Transport.

She faces 119 charges of tax evasion, fraud and contravening the Close Corporations Act by remaining a member of a business despite being convicted of tax fraud in 2005.

Mpisane has pleaded not guilty.
