Brickz bail ruling expected Tuesday

The bail application by rape accused and musician Sipho Ndlovu was postponed by the Roodepoort Magistrate's Court on Monday.

Magistrate Piet Kotze postponed the case to Tuesday, when he would make his ruling.

Ndlovu, who performs under the name Brickz, has been in custody since November 1 for allegedly raping a 16-year-old girl in March.

In an affidavit submitted as part of his bail application, Ndlovu denied raping the girl and indicated he intended pleading not guilty.

Prosecutor Willem le Roux opposed his bail application. He said even without a passport Ndlovu could easily leave the country if granted bail.

He said the award-winning Kwaito star did not have a fixed address, neither did he have a property registered in his name.

Ndlovu posed a danger to his victim and his wife, said Le Roux.

Isaac Mokgopi, for Ndlovu, said his client would not flee and would stand trial. He said Ndlovu had not committed any crime after he was arrested for drug possession in 2007. Ndlovu paid a fine.

Mokgopi asked that the court release Ndlovu on R2 000 bail.
