Sangoma cries fowl in court

An Eastern Cape sangoma, who was convicted for the possession of vulture feet, wants the Constitutional Court to declare the legislation under which she was convicted invalid.

Nokhanyo Khohliso was convicted for the possession of two vulture feet in 2010 and was fined R4000 by the Tsolo Magistrate's Court. She successfully appealed her conviction last year in the Mthatha High Court, which declared the legislation under which she was convicted invalid.

Khohliso said she had intended using the feet to make muti to protect her clients from theft.

She was convicted under a 1992 decree that applied only in the former Transkei homeland.

The province's advocate said the Constitutional Court did not have the jurisdiction to pronounce on the validity of the decree because it was homeland legislation.
