N12 crash law irks court

There should be legislation to hold the owners of trucks and those who inspect them collectively responsible for road accidents.

This was the call from Magistrate Zithulele Hlubi, who yesterday granted Isaac Maruding R7000 bail. Maruding allegedly caused the horror crash that killed four people and injured 26 on the N12 in Alberton, Johannesburg, two weeks ago.

He is charged with three counts of culpable homicide and one of reckless and negligent driving. Henry Mohloai, Henry Mnisi, Sidwell Ngqoboka and a fourth, unidentified, person died, and 48 vehicles were damaged.

Maruding was arrested in Potchefstroom the day after the accident and said he will plead not guilty.

Maruding was convicted of culpable homicide in 1999, and Hlubi noted that he attended the trial faithfully.

"I am waiting for the day when the legislation will prosecute the above [truck owners and inspectors of trucks] as stakeholders," the magistrate said. He said drivers were in a "desperate situation".

The case was postponed to next month for investigation.
