Parent sues for a place in school

A JOHANNESBURG father has gone to court in a bid to secure a place for his child after the former model C school of his choice told him there was no space for his daughter in Grade 8 next year.

The case comes barely a week after the court issued a landmark ruling that the authority to determine when a state school is full rests with the education department, not with schools.

In this case, the father, who may not be named to protect the identity of his daughter, 13, took the Department of Basic Education, the Gauteng Education Department and the school to court.

The father, a businessman from Florida Glen in western Johannesburg, has asked for an order to compel authorities to find a suitable English-medium school within reasonable distance from their home.

Gauteng Education Department spokesman Charles Phahlane said it was opposing the application because, he said : "The parents submitted incorrect information to the school about place of residence and work in an attempt to unduly find placement at the school."

He said the department had offered the pupil space at another school in her area, but the parents had rejected it.

The case was postponed to January 9 for judgment.
