Banned sprinter Magakwe’s counsel ‘didn’t pay appeal filing fee’

Sprinter Simon Magakwe’s hope of appealing his two-year doping ban is over‚ according to the Court of Arbitration for Sport (CAS) in Switzerland. Magakwe‚ the only South African to have run the 100m in under 10 seconds‚ was suspended in early February after refusing to submit to an out-of-competition doping test in December.The IAAF‚ the world governing body for athletics which had overseen the attempted test and disciplinary proceeding‚ last week confirmed Magakwe’s two-year ban‚ saying the athlete had missed the 45-day deadline to lodge his appeal.Magakwe’s lawyer‚ Mohale Magoshi‚ countered this week by saying that an appeal was filed on time‚ on March 10.But a CAS official said in an email from Lausanne: “Counsel for Mr Magakwe did file a notice with CAS but did not pay the filing fee of CHF1000 (nearly R13‚000) despite reminders.“Consequently‚ since the appeal was incomplete‚ the CAS could not initiate an arbitration procedure in this matter.”Magoshi said he was awaiting further instruction from his client‚ but the CAS official said the matter was over because Magakwe had missed the window period.Asked if the matter was now closed‚ the official replied: “The deadline has indeed passed‚ as indicated by the IAAF.” – The Times..
