MPs are set to debate the report calling for land expropriation without compensation.

After an extensive public participation process, the Constitutional Review Committee recommended that section 25 of the Constitution be amended to include an explicit clause which provides for expropriation of land without compensation.

The Western cape high court last week dismissed  AfriForum's attempt to interdict the process. AfriForum argued that parliament’s public participation process was inadequate and that the process followed by the committee was flawed.

The National Assembly and the National Council of Provinces will simultaneously consider the report. Should both Houses adopt the report, it will pave the way for a bill to be introduced. At that stage, parliament will again invite further public comments, in terms of its constitutional obligations.
